Divorce for Men
If a man wants to dissolve his marriage, the procedure depends on his faith:
⦁ Sunni Muslims: A Sunni man can pronounce Talaq in the presence of two adult Muslim witnesses. Our law firm will send a notice to the wife and start a 90-day reconciliation process. If no reconciliation happens, the divorce becomes effective.
⦁ Shia Muslims: Shia divorce has its own rules. The process may differ, and we assess each case based on its unique context sometimes immediate Talaq, sometimes phased over time.
⦁ Christians: Under the Christian Divorce Act, 1869, a Christian man must go to Family Court and prove allegations such as adultery for the divorce to be granted. alternatively, divorce can be done with the help of witnesses.
Khula/ Divorce by Women
A woman in Pakistan can seek a Khula through Family Court under the Family Courts Act, 1964 & Shariah Law. Once the court issues a decree, the marriage is dissolved, and we will obtain a Divorce Effectiveness Certificate.
